Area45’s Web sites may contain links to other Web sites. The information practices or the content of such other Web sites is governed by the privacy statements of such other Web sites. Area45 collects individually-identifiable information (“Personal Information”) from individuals who visit the Company’s Web site (“Web Site Visitors”) and individuals who register to use the Services (“Customers”). When expressing an interest in obtaining additional information about the Services or registering to use the Services, Area45 requires you to provide the Company with personal contact information, such as name, company name, address, phone number, and email address (“Required Contact Information”). When purchasing the Services, Area45 may require you to provide the Company with financial qualification and billing information, such as billing name and address, credit card number, and the number of employees within the organization that will be using the Services (“Billing Information”). Area45 may also ask you to provide, or otherwise allow you to share, additional information, which you may choose to share in your registration for or use of the Services (“Optional Information”). Required Contact Information, Billing Information, and Optional Information about Customers are referred to collectively as “Data About Customers”. As you navigate the Company’s Web sites or use the Services, area45 may also collect information through the use of commonly-used information-gathering tools, such as cookies and Web beacons (“Web Site Navigational Information”). The Company uses Data About Customers to perform the services requested. For example, if you fill out a “Contact Me” Web form, the Company will use the information provided to contact you about your interest in the Services.
The Company may also use Data About Customers for marketing purposes. For example, the Company may use information you provide to contact you to further discuss your interest in the Services and to send you information regarding the Company, its affiliates, and its partners, such as information about promotions or events. Please view the Communications Preferences section of this Privacy Statement to control how your respective Data About Customers is used for marketing purposes.
Area45 uses Billing Information solely to check your financial qualifications and collect payment for the Services.
Area45 uses Web Site Navigational Information to operate and improve the Company’s Web sites. The Company may also use Web Site Navigational Information alone or in combination with Data About Customers to provide personalized information about the Company and the Services. For additional information about the use of Web Site Navigational Information, please review Section 4 of this statement. Area45 may use both Data About Customers and Web Site Navigational Information to enforce the Company’s Web site policies, or to protect the Company’s rights and intellectual property or the rights of others using the Company’s Web sites or the Services.
Cookies, Web Beacons and IP Addresses
Area45 uses commonly-used information-gathering tools, such as cookies and Web beacons, to collect information from your computer or mobile device as you navigate the Company’s Web sites, interact with e-mails sent by the Company on its own behalf, or use the Services (“Web Site Navigational Information”), . This section describes the types of Web Site Navigational Information used on the Company’s Web sites and in connection with the Services, and how this information may be used.
Cookies
Area45 uses cookies to make interactions with the Company's Web site easy and meaningful. When you visit one of the Company's Web site, area45’s servers send a cookie to your computer. Standing alone, cookies do not personally identify you; they merely recognize your Web browser. Unless you choose to identify yourself to area45, either by responding to a promotional offer, opening an account, or filling out a Web form (such as a “Request a callback” Web form), you remain anonymous to the Company.
Area45 uses cookies that are session-based and persistent-based. Session cookies exist only during one session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you close your browser or turn off your computer. Please note that if you disable your Web browser’s ability to accept cookies, you will be able to navigate the Company's Web site, but you will not be able to successfully use the Services.
Web Beacons
Area45 uses Web beacons alone or in conjunction with cookies to compile information about Customers and Visitors’ usage of the Company's Web site and interaction with emails from the Company. Web beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular Web site tied to the Web beacon, and a description of a Web site tied to the Web beacon. For example, area45 may place Web beacons in marketing emails that notify the Company when you click on a link in the email that directs you to one of the Company's Web site. Area45 uses Web beacons to operate and improve the Company's Web site and email communications.
Use of Tracking Technologies
We may use Tracking Technologies for a variety of purposes, including:
Strictly Necessary. We may use cookies or other Tracking Technologies that we consider are strictly necessary to allow you to use and access the Company's Web site, including cookies required to prevent fraudulent activity, improve security or allow you to make use of site functionality.
Performance-Related. We may use cookies or other Tracking Technologies that are useful in order to assess the performance of the Company's Web site, including as part of our analytic practices or otherwise to improve the content, products or services offered through the sites.
Functionality-Related. We may use cookies or other Tracking Technologies that are required to offer you enhanced functionality when accessing the Company's Web site, including identifying you when you visit the sites or keeping track of our specified preferences, including in terms of the presentation of content on our sites.
Targeting-Related. We may use Tracking Technologies to deliver content, including ads, relevant to your interests on the Company's Web site and third-party sites based on how you interact with our content and ads. This includes using Tracking Technologies to understand the usefulness to you of the content and ads that have been delivered to you.
There may be other Tracking Technologies now and later devised and used by us in connection with the Company's Web site. Further, third parties may use Tracking Technologies in connection with our sites, which may include the collection of information about your online activities over time and across third-party web sites or online services. We may not control those Tracking Technologies and we are not responsible for them. However, you consent to potentially encountering third-party Tracking Technologies in connection with use of the Company's Web site and accept that our statements under this Privacy Policy do not apply to the Tracking Technologies or practices of such third parties.
IP Addresses and URLs
Due to Internet communications standards, when you visit or use the Company’s Web site, we automatically receive the URL of the Web site from which you came and the Web site to which you go when you leave the Company’s Web site. We also receive your computer’s Internet Protocol (IP) address (or the proxy server you use to access the World Wide Web), your computer operating system, the type of Web browser you are using, and your Internet Service Provider (ISP). This information is used to analyze overall trends to help us improve the Service and to track and aggregate non-personal information. For example, area45 uses IP addresses to monitor the regions from which Customers and Web Site Visitors navigate the Company’s Web sites.
Area45 may collect aggregated data regarding use of the Services and the Company’s Web site, including, without limitation, number of Web Site Visitors to the Company’s Web site, frequency and patterns of use, tag usage, feedback request trends, etc. (“Aggregated Data”). Area45 uses Aggregated Data as a statistical measure and not in a manner that would identify you personally. Aggregated Data enables us to determine how often certain parts of the Company’s Web site or the Services are used so that we can improve them. Area45 may make use of, or make such Aggregated Data available to, third parties, in any manner in our sole discretion.
Social Media Features
The Company's Web site may use social media features, such as the Facebook 'like' button ("Social Media Features"). These features may collect your IP address and which page you are visiting on the Company's Web site, and may set a cookie to enable the feature to function properly. You may be given the option by such Social Media Features to post information about your activities on the Company's Web site to a profile page of yours that is provided by a third party Social Media network in order to share with others within your network. Social Media Features are either hosted by a third party or hosted directly on the Company’s Web site. Your interactions with these features are governed by the privacy policy of the company providing the relevant Social Media Features.
Do Not Track
Currently, various browsers – including Internet Explorer, Firefox, and Safari – offer a “do not track” or “DNT” option that relies on a technology known as a DNT header, which sends a signal to Web sites' visited by the user about the user's browser DNT preference setting. Area45 does not currently commit to responding to browsers' DNT signals with respect to the Company's Web site, in part, because no common industry standard for DNT has been adopted by industry groups, technology companies or regulators, including no consistent standard of interpreting user intent. Area45 takes privacy and meaningful choice seriously and will make efforts to continue to monitor developments around DNT browser technology and the implementation of a standard.
Service Enabled Tracking
The Services may be used by our Customers to collect certain information about individuals and their online activities, such as interactions with a Customer’s Web site or in relation to a Customer’s online advertisements, content and communications using cookies and other tracking technologies. Customers are responsible for complying with any legal requirements in using any tracking technologies made available through the Services, including complying with any notice and consent requirements, and disclosing the use of such technologies in their respective privacy statements.
Area45 may provide bulletin boards, blogs, or chat rooms on the Company's Web site. Any personal information you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. Area45 is not responsible for the personal information you choose to submit in these forums.
Customers and Visitors may elect to use the Company’s referral program to inform friends about the Company's Web site. When using the referral program, the Company requests the friend’s name and email address. Area45 will automatically send the friend a one-time email inviting him or her to visit the Company's Web site. Area45 does not store this information.
Area45 posts a list of Customers and testimonials on the Company's Web site that contain information such as Customer names and titles. Area45 obtains the consent of each Customer prior to posting any information on such a list or posting testimonials.
Service Providers
Area45 may share Data About area45 Customers and Data About area45 Attendees with the Company's contracted service providers so that these service providers can provide services on our behalf. Without limiting the foregoing, Area45 may also share Data About area45 Customers and Data About area45 Attendees with the Company's service providers to ensure the quality of information provided, and with third-party social networking and media Web sites, such as Facebook, for marketing and advertising on those Web sites. Unless described in this Privacy Statement, area45 does not share, sell, rent, or trade any information with third parties for their promotional purposes.
Area45 Affiliates
The Company may share Data About area45 Customers with other companies in order to work with them, including affiliates of the area45 corporate group. For example, the Company may need to share Data About area45 Customers for customer relationship management purposes.
Business Partners
From time to time, area45 may partner with other companies to jointly offer products or services. If you purchase or specifically express interest in a jointly-offered product or service from area45, the Company may share Data About area45 Customers collected in connection with your purchase or expression of interest with our joint promotion partner(s). Area45 does not control our business partners’ use of the Data About area45 Customers we collect, and their use of the information will be in accordance with their own privacy policies. If you do not wish for your information to be shared in this manner, you may opt not to purchase or specifically express interest in a jointly offered product or service.
Third Parties
This Privacy Statement sets forth the information area45 collects on the Company's Web site and the information we share with third parties. Area45 does not authorize the collection of personal information by third parties through advertising technologies deployed on the Company's Web site, nor do we share personal information with any third parties collected from the Company's Web site, except as provided in this Privacy Statement. Section 4 of this Privacy Statement, Web Site Navigational Information, specifically addresses the information we collect through cookies and web beacons, and how you can control cookies through your Web browsers.
Billing
Area45 uses a third-party service provider to manage credit card processing. This service provider is not permitted to store, retain, or use Billing Information except for the sole purpose of credit card processing on the Company’s behalf.
Compelled Disclosure
Area45 reserves the right to use or disclose information provided if required by law or if the Company reasonably believes that use or disclosure is necessary to protect the Company’s rights and/or to comply with a judicial proceeding, court order, or legal process.
To facilitate area45’s global operations, the Company may transfer and access Data About Customers from around the world, including the United States and other countries in which the Company has operations. This Privacy Statement shall apply even if area45 transfers Data About Customers to other countries. For European Web Site Visitors and Customers, please note that in order to provide the information or services requested, your Personal Information may be transferred outside of the European Economic Area (“EEA”). By visiting the Company Web site or using the Services, you agree to area45 transferring your Personal Information outside the EEA.
Area45 offers Web Site Visitors and Customers who provide contact information a means to choose how the Company uses the information provided. You may manage your receipt of marketing and non-transactional communications using the preference settings available through the Services, if any or by clicking on the “unsubscribe” link located on the bottom of the Company’s marketing emails. Additionally, you may send a request specifying your communications preferences support@area45.io . Customers cannot opt out of receiving transactional emails related to their account with area45 or the Services.
Customers may update or change their registration information by editing their user or organization record. To update a user profile or to update an organization’s information, please login to www.area45.io with your applicable username and password and edit your user settings, or send your request to support@area45.io . To update Billing Information or have your registration information deleted, or to discontinue your account, please email support@area45.io . Requests to access, change, or delete your information will be handled within 30 days. You may also wish to contact the system administrator for your instance of the Services for assistance in correcting or updating your information.
Area45 retains the information we receive as described in this Privacy Statement above for reasonable duration, for example, as the case may be, for as long as needed to provide our Services, comply with our legal obligations, resolve disputes, establish legal defenses, to conduct audits, pursue legitimate business purposes, and enforce our agreements.
As part of using our Services, Customers may submit electronic data or information to the Services (“Customer Data”) which may include Personal Information. The Company generally has no direct relationship with the individuals to whom Customer Data may pertain, which we process on the behalf of our Customers. Any uses of Customer Data by the Company are done so pursuant to the Company’s Terms of Service or a subscription agreement in place between the Company and the relevant Customer (or his/her organization), which exclusively govern the Company’s treatment of Customer Data and supersede this Privacy Statement in case of conflict, or as required by law. If Personal Information pertaining to you as an individual has been submitted to us by a Customer as Customer Data and you wish to exercise any rights you may have to access, correct, amend, or delete such data, please inquire with the Customer (or his/her organization) directly. If an authorized Customer requests that we update or remove the data in question and the Customer has no ability to do so via use of the Services, we will acknowledge their request within 30 days. Area45 takes precautions, including administrative, technical, and physical measures – to help safeguard Data About Customers against loss, theft, and misuse as well as unauthorized access, disclosure, alteration, and destruction. While we follow generally accepted standards to protect information submitted to us, including the use of secure socket layer (SSL) technology, no method of storage or transmission is 100% secure. Users are solely responsible for protecting their passwords, limiting access to their computers, and signing out of the Services after their sessions.
Without limiting the generality of this Privacy Policy, in addition to information gathered through its Web sites or submitted to its Services, area45 may obtain information through applications (“Mobile Applications”) that Customers or their authorized individuals (“Users”) download to, and run on, their mobile devices (“Devices”). Mobile Applications provided by area45 may obtain information from, or access data stored on, Users’ Devices to provide services related to the relevant Mobile Application. For example, a Mobile Application may: access a camera on a User’s Device to enable the User to upload photographs to the Services; access calendar information on a User’s Device to enable the User to synchronize the calendar with the Services; or access contact information on a User’s Device to enable the User to sync contact information between the information that is stored on the User’s Device and the information that is submitted to the Services. Information obtained to provide Mobile Application services may include information obtained in preparation for anticipated updates to those services. Mobile Applications may transmit information to and from Devices to provide the Mobile Application services.
Mobile Applications may provide area45 with information related to Users’ use of the Mobile Application services, information regarding Users’ computer systems, and information regarding Users’ interaction with Mobile Applications, which area45 may use to provide and improve the Mobile Application services. For example, all actions taken in a Mobile Application may be logged, along with associated information (such as the time of day when each action was taken). Area45 may also share anonymous data about these actions with third party providers of analytics services. In addition, if a User downloads an area45 Mobile Application after clicking on a third-party mobile advertisement for the Mobile Application or for area45, the third-party advertiser may provide area45 with certain information, such as the User’s Device identification information, which area45 may use to track the performance of its advertising campaigns.
Customers may configure area45 Mobile Application services, and the information accessed or obtained by the Mobile Application on a User’s Device may be affected by the Customer’s configuration. In addition, if a Customer purchases more than one Service from area45 and its affiliates, a Mobile Application may be designed to interoperate with those Services; for instance, to provide a User with access to information from any or all of those Services or to provide information from a User’s Device to any or all of those Services. Information accessed or obtained by the Mobile Application on a User’s Device may be accessible to the Customer and its organization, depending on the intended functionality of the Mobile Application.
Notices and contractual terms related to a particular Mobile Application may be found in the End User License Agreement or relevant terms of service for that application. The Company encourages you to review the End User License Agreement or relevant terms of service related to any Mobile Applications you download, install, use, or otherwise interact with to understand that Mobile Application’s information practices.
Area45 reserves the right to change this Privacy Statement. Area45 will provide notification of the material changes to this Privacy Statement through the Company's Web site at least thirty (30) business days prior to the change taking effect.
